Sub:- Customs – Joint Working Group – Joint Cargo Complex – Functioning – Renewal of – reg.

            The Commissioner of Customs, Bangalore, had specified the limits of Customs Area in respect of JOINT WORKING GROUP – JOINT CARGO COMPLEX, Opposite HAL Helicopter Division, HAL Airport, Bangalore-560 037, vide Notification No.7/2009 Cus (N.T) dated 20-10-2009 and had subsequently appointed ‘M/s Joint Working Group’ as the Custodian vide Notification No.08/2009 dated 20-10-2009 which was valid up to 31-03-2010.

 

            Now, in exercise of the powers conferred under Section 45(1) of the Customs Act, 1962, I, B. BHATTACHARYA, Commissioner of Customs, Bangalore hereby appoint “M/s Joint Working Group” to be custodian for all goods unloaded in the aforementioned Customs Area meant for import, export and transshipment in accordance with the provisions of the said Act for a further period upto 31-03-2012, and subject to the following conditions:

 

1)       The Custodian shall comply with the Handling of Cargo in Customs Area Regulations, 2009, issued vide Notification No.26/2009-Cus (NT) dated 17-03-2009, as amended from time to time.

 

2)       The Custodian of the goods meant for import and export would be required to comply with the provisions of Section 45 and other relevant Sections of the Customs Act, 1962, and Rules & Regulations made there under as well as the instructions issued from time to time in this regard.

 

3)       The Custodian shall be responsible for the proper receipt, handling, storage and shall be accountable for the loss of goods either imported or those meant for export or transshipment after their receipt and before their intended purpose.  The Custodian shall maintain proper record of all such goods including those disposed of under Section 48 or otherwise.

 

4)       If any imported/export/transshipment goods are pilfered or lost after unloading in the Customs area and while in the custody of the Custodian, then the Custodian shall be liable to pay duty on such pilfered/lost goods in terms of provisions of Section 45(3) of the Customs Act, 1962.

 

5)       The imported/export/transshipment goods, which are not cleared for their intended purpose within 30 days or within the extended period as the proper officers may allow; or in case of relinquishment of title by the importer in terms of Section 23(2) of the Customs Act, 1962, such goods shall not be sold without obtaining permission from the proper officer of Customs under the provisions of the Section 48 of the Customs Act, 1962.

 

6)       The Custodian shall provide safe, secure and spacious place for loading/unloading/storage of the cargo.

 

7)       The Custodian shall provide sufficient modern handling equipment in operational condition for handling the cargo in the notified area.

 

8)       The Custodian shall provide 4500 Sq.ft. of free furnished office space for Customs in their Cargo terminal.  The area of 4500 Sq.ft. shall be utilized by Bangalore Customs for the activities mentioned in Annexure to the Notification No.8/2009 dated 20-10-2009.  No alteration of the plan in the accommodation, boundary wall and building, etc., shall be made without the concurrence of the Commissioner of Customs, Bangalore.

 

9)       The Custodian shall provide 1500 Sq.ft of office space for Customs in the Sheds.

 

10)   Entire cargo within the Joint Working Group-Joint Air Cargo Complex shall be insured by the Custodian.

 

11)   The said Custodian shall comply with the provisions of Section 45(2) of the said Act as well as with all Rules, Regulations and instructions in existence and issued from time to time in this regard.

 

12)   Security of the Air Cargo Complex shall be the responsibility of the Custodian subject to the prior approval of the Commissioner of Customs. The cost of the security shall be borne by the Custodian.

 

13)    The Custodian shall bear the cost of the Customs staff posted at the Joint Working Group-Joint Air Cargo Complex.

 

14)   The Custodian shall make adequate arrangements for sanitary facility, water supply and other facilities including the canteen facility for the officers working in the Joint Working Group-Joint Air Cargo Complex.

 

15)   Custodian shall not charge any rent/ demurrage for the goods detained by the Customs Department under the Customs Act for the time being in force.

 

16)   In case the Custodian intends to sublet any of the functions inside the Customs area or connected with the Customs area, the same shall be done with the prior approval of the Commissioner of Customs and the Custodian shall remain responsible for all omissions and commissions of such agency.

 

17)   Uninterrupted thoroughfare shall be provided to the Customs officials in the entire premises of customs area.

 

18)   Free suitable transport facility shall be provided by the custodian for the Customs staff posted at the Joint Working Group-Joint Air Cargo Complex.

 

19)   Custodian shall be responsible for any improper removal of imported/export goods and shall be liable to pay appropriate Duties, Cess, etc., on such improper removals.

 

20)   The Custodian is required to provide for increase in space and infrastructure as and when requisitioned by the Customs.

 

21)   In the event of the Custodian being found not able to achieve and sustain expected service/delivery standards and is not able to improve even after being informed by the Commissioner of Customs, Bangalore-the notifying authority, the Commissioner of Customs, Bangalore, reserves the right to denotify or relocate the processing/handling activities to other Custodians.

 

            This may be brought to the notice of all concerned.
